According to the Labour Code, an employee is entitled to holiday leave. Three main features characterise it. It is:

  • annual
  • uninterrupted
  • payable.

An employee may not waive the right to annual leave. The employer must grant the leave in the calendar year in which the employee became entitled to it.

The amount of annual leave is:

  • 20 days – if the employee has been employed for less than 10 years,
  • 26 days – if the employee has been employed for at least 10 years.

An employee hired for the first time in a given calendar year in which he started work is entitled to leave with the passing of each month of work. It is in the amount of 1/12 of the annual leave to which he or she would be entitled after working for a year. The employee acquires the right to the next leave in each subsequent calendar year.

Public holidays and non-working days in 2025 amount to a total of 115 days, of which:

  • 13 days are public holidays,
  • 4 public holidays fall on Saturday or Sunday (Easter, Constitution Day of 3 May, Corpus Christi, All Saints’ Day),
  • 9 holidays in 2025 fall during the working week (Monday to Friday).

If we take into account holidays and non-working days in 2025, there will be 250 days left to work next year.

Public Holidays and Days Off in 2025 – holiday falling on a Saturday

According to the Labour Code, each public holiday falling on a day other than Sunday reduces the working time by 8 hours. This means that for a holiday falling on a Saturday,  an employee is entitled to a day off in the same settlement period.

In this regard, an employer:

  • is obliged to grant this day off,
  • decides when it will take place – before, after the holiday or on another date in a given settlement period.
  • There is no legal obligation to consult the time off with employees.

Public Holidays and Days Off in 2025 – who is entitled to leave for a holiday falling on a Saturday?

An extra day off for a holiday on a Saturday is only given to employees who usually do not work on Saturdays. This means that employees:

  • who do not work on Saturdays will receive a day off at a different time within the settlement period,
  • working on Saturdays will not have to work on that day, but they will also not be paid for it.

Sunday is already a day off for all full-time employees. Therefore, holidays falling on Sundays do not affect the working time or the number of days off to which the employee is entitled.
